We recognize that privacy is an important issue. This Privacy Policy outlines the types of personal information Augme Technologies, Inc. (“Augme” or the “Company”) gathers when you use our Websites, www.augme.com, www.hipcricket.com or the Adlife Platform, as well as some of the steps we take to safeguard your privacy.

Augme has been awarded TRUSTe's Privacy Seal signifying that Augme’s Privacy Policy and Practices (the “Policy”) have been reviewed by TRUSTe for compliance with TRUSTe's program requirements and the TRUSTed Cloud Program Requirements including transparency, accountability and choice regarding the collection and use of your personal information. TRUSTe's mission, as an independent third party, is to accelerate online trust among consumers and organizations globally through its leading privacy trustmark and innovative trust solutions. The TRUSTe program covers only information that is collected through the Company Websites: www.augme.com, www.hipcricket.com and our service platform, Adlife, adlife.augme.com. The data collected through Client mobile applications, campaigns, or websites is owned by our clients.

Information Collected on Our Websites

Personal Information

"Personally identifying information" is information that individually identifies you, such as your name, physical address, phone number or email address. We do not require you to provide such information to participate in our Websites.

Augme, or its wholly owned subsidiary Hipcricket, Inc. (“Hipcricket”), also collects personal information of third parties such as name, email, address and telephone. Approved users of the Adlife platform, with appropriate permissions, can create new user or contact accounts by entering the above personal information. To update, change or delete your account, contact your Adlife administrator or contact support@augme.com.

Augme, or Hipcricket, may collect limited non-personally identifying information that your browser makes available whenever you visit a website. This log information includes your Internet Protocol address, browser type, browser language, the date and time of your query and one or more cookies that may uniquely identify your browser. We use this information to operate, develop and improve our services.

How we Use your Personal Information

• To operate our Websites and deliver the services you have requested;
• To inform you of other products or services available from Augme or Hipcricket;
• To respond to your questions and concerns;
• To improve our Websites and marketing efforts; and
• To contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

Information Sharing

We will share your personal information with third parties only in the ways that are described in this privacy statement. We do not rent or sell your personally identifying information to other companies or individuals, unless we have your consent. We may share such information in any of the following limited circumstances:

• As required by law such as to comply with a subpoena, or similar legal process;
• When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others and when there is an fraud investigation or government request which requires Augme to respond;
• If Augme is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email or a prominent notice through our Websites of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information; and
• With your prior consent, provide your information to any other third party.

We may store and process personal information collected on our site in the United States or any other country in which Augme or its agents maintain facilities. By using our services, you consent to the transfer of your information among these facilities, including those located outside your country.

Log Files

As is true of most Websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

We do not link this automatically-collected data to personally identifiable information.

We use a third-party tracking service called Google Analytics that uses cookies and log files to track non-personally identifiable information about visitors to our site in the aggregate. Google Analytics tracking (and most web tracking software) uses cookies in order to provide meaningful reports about our site visitors. However, Google Analytics cookies do not collect personal data about website visitors. Augme’s Websites use "cookies" to help personalize your online experience. A cookie is a text file that is placed on your hard disk by a Web page server. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Our Site may include links to other Websites whose privacy practices may differ from those of Augme, or its wholly owned subsidiary Hipcricket. Access

If you have submitted personally identifiable information through our Websites, www.augme.com or www.hipcricket.com and if it has changed, or if you no longer desire our service, you may request that we correct, update, amend, or delete it by emailing Customer Support at support@augme.com, or by contacting us by telephone or postal mail at the contact information listed below.

Data Retention

We will retain your information for as long as your account is active or as needed to provide you services. If you wish to cancel your account or request that we no longer use your information to provide you services contact us at support@augme.com. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Information collected for our Clients through the AdLife Platform

The collection and use of information shall be limited to the purpose of providing the service for which the Client has engaged Augme, or its wholly owned subsidiary Hipcricket.

Data Retention: Augme or Hipcricket will retain the data we process or store on behalf of our Clients for as long as needed to provide services to our Clients. Augme or Hipcricket will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Access: As a service provider, Augme or Hipcricket has no direct relationship with the individuals whose data it processes. An individual who seeks access, or who seeks to correct, amend, or delete inaccurate data should direct their query to the respective client of Augme or Hipcricket, (the data controller), which has transferred such data for processing, or approved the use of a data collecting application on their behalf. If the client requests to remove the data, Augme or Hipcricket will respond to their Client’s request within 30 business days.

Notice: As a service provider processing information under the direction of its Clients, Augme or Hipcricket has no direct relationship with the individuals whose data it processes. Augme or Hipcricket works with its Clients to help them provide notice of data processing to individuals, including information concerning (1) the purposes for which personal information is collected and used; (2) a contact person to whom enquiries or complaints may be directed; (3) the types of third parties to whom personal information is disclosed if applicable; and (4) the choices and means that individuals are offered for limiting use and disclosure of personal information.

Choice: As a service provider processing personal information under the direction of its Clients, Augme or Hipcricket has no direct relationship with the individuals whose personal data it processes. Augme or Hipcricket may disclose personal data to third parties in the course of processing personal data. Augme or Hipcricket only processes information in accordance with its Clients instructions, and only for purposes that are compatible with those for which it was originally collected or subsequently authorized by the individual.

Changes to this Policy

We may update this privacy statement to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Site prior to the change becoming effective.
